Merrick Garland had agreed not to make the special counsel’s findings in the classified documents investigation public while the DOJ appealed a judge’s dismissal of the case.

The Justice Department filed a motion Wednesday to drop all criminal proceedings against two former Trump co-defendants charged in the special counsel's classified documents case, putting a final end to the probe more than two years after it began.

The department’s motion to drop the case was signed by Hayden O’Byrne, who was appointed as the “interim” U.S. Attorney in Miami on Monday at the same time as the firings. O’Byrne, a member of the conservative Federalist Society, was hired as a prosecutor by the U.S. Attorney’s Office in 2019.

The DOJ asked a federal court to dismiss its case against two men indicted for allegedly helping Trump conceal classified documents. Prosecutors dropped Trump from the case after his election win.

Trump appointee Aileen Cannon had dismissed the classified documents case against the now-president and two co-defendants. The DOJ under special counsel Jack Smith had appealed.
